hk3k Terms of Service

1. Agreement to Terms

By accessing or using hk3k ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

Beta & Early Access Features

Some hk3k features may be newly released or offered in early access
These features may be experimental and subject to change without notice
Beta and early access features may have:

- Intermittent interruptions
By using these features, you acknowledge that hk3k is not responsible for any issues arising from their use
Features may evolve over time based on user feedback and improvements

3. User Content

Your Content

You retain all rights to the content you save using hk3k. By using the Service, you grant us a limited license to process and store your content solely for the purpose of providing the Service to you.

AI Output Disclaimer

The AI-powered suggestions, notes, or search results provided by hk3k are for informational purposes only. These outputs are generated using AI based on your inputs and may include information sourced from public internet content. They may not be accurate, complete, or up-to-date.

These outputs are not legally, financially, or medically binding, and you should independently verify any information before making decisions.

Content Responsibility

You are solely responsible for the content you save and share through the Service. You represent that you have the right to use any content you save.

Prohibited Content

You agree not to save or share content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.

4. Intellectual Property Rights

Our Property

The Service and its original content (excluding user content), features, and functionality are and will remain the exclusive property of hk3k, Inc. and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used without our prior written consent.

Your License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal or internal business purposes.

5. Payment Terms

Subscription Fees

Billed in advance on a monthly or annual basis
Non-refundable except as required by law
Automatic renewal unless cancelled

Changes to Pricing

30 days notice for price increases
Grandfathered pricing for existing users
Option to cancel before changes take effect

Plain Language Note:

Some existing users might be allowed to keep their current subscription rate even if prices increase. This is optional and decided by hk3k, so not everyone is guaranteed to keep the old price.

Payment Processing

All payments are processed securely through trusted third-party providers (e.g., Stripe). We do not store your payment card details. You agree to provide current, complete, and accurate billing information.

6. Termination

Your Right to Terminate

You may terminate your account at any time through your account settings or by contacting support. Upon termination, your right to use the Service will immediately cease.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms.

Effects of Termination

Upon termination, your right to use the Service will cease immediately. You may request a copy of your data, which we will provide within a reasonable period (not to exceed 30 days). Data deletion will follow the timelines described in our Privacy Policy.

7. Children's Use

hk3k is not intended for children under 13 (or the minimum digital consent age in your jurisdiction)
Children above the age of consent may use the Service with parental consent
Personal data of minors is collected only as needed for service functionality and is never used for marketing or AI training without parental consent
Parents can review or request deletion of a child's data by contacting legal@hk3k.ai

8. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. We make no warranties, expressed or implied, and hereby disclaim all warranties including, without limitation, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

The Service will function uninterrupted or error-free
The Service will be free of viruses or other harmful components
The results obtained from use will be accurate or reliable
Any errors in the Service will be corrected

The AI-powered suggestions, notes, or search results provided by hk3k are for informational purposes only. These outputs may include information sourced from the public internet and other data used to train the AI. They are not legally, financially, or medically binding, and users should independently verify any information before making decisions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HK3K SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

In no event shall our aggregate liability exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless hk3k, Inc., its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in San Francisco County, California.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

13. Claims of Copyright Infringement

At hk3k, we respect the rights of copyright holders. If you believe that content stored or shared via hk3k infringes your copyright, please notify us promptly.

Your notice should include:

A description of the copyrighted work you believe has been infringed
Identification of the content in question (e.g., notes, links, or saved material)
Your contact information (name, email, phone)
A statement that you believe in good faith that the use is unauthorized
A statement that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf

14. Miscellaneous

Entire Agreement

These Terms constitute the entire agreement between you and hk3k regarding the Service.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.

Waiver

Our failure to enforce any right or provision will not be considered a waiver of those rights.
